KAI Distribution Centre Ltd Terms & Conditions of Sale. We strongly recommend that you read and understand these terms of business before proceeding further.

Section 1: For Certificated KAI Practitioners ordering and using KAIs:

1. Only Certificated Practitioners† are permitted to order the KAI. Certificated Practitioners† may not supply or resell KAI to others; nor permit non-certificated persons to use or interpret the measure. Even if the Certificated Practitioner† does not purchase with his/her own funds, this is still a condition of sale. Certificated Practitioners† in company employment must, should they leave, hand them to another Certificated Practitioner† in that company, (notifying ORC) destroy them or take them with them.

2. Only Certificated Practitioners† are permitted to use KAI. Certificated Practitioners† are entirely responsible for the proper and ethical use of KAI; accuracy of the scoring and feedback; the security of any stored data; the security of unused KAIs and the manual.

3. Under no circumstances should uncertificated persons be left with their (any) response sheet, for any reason. There are many reasons for this restriction (see manual). If a certificated person does leave a KAI in uncertificated hands, then liability for its subsequent misuse, as well as possible breach of copyright, may fall upon that person (see also above).

4. No KAI item (or the item list) is to be published, in any form, without written permission. Certificated Practitioners† are not to breach or be involved in any breaching of copyright of KAI and any associated material, e.g., manual, or be associated with the production of a rival or alternative form.

5. KAI is not a self-scored measure. Only Certificated Practitioners† must score KAI and this condition must be taken into account when planning sessions.

6. There should be proper reason for the collection of data. Such reason(s) should be known fully by the respondent before being asked to respond. Conflicts of interest should be made clear and explained and steps taken to eliminate them, e.g., assessment centres offering personal advice AND assisting administrations on redundancy, promotion, etc., relating to the same people.

7. Respondents should be offered feedback. If this cannot be done then this must be clearly stated before being asked to respond. In offering feedback, Certificated Practitioners† must allow (negotiate) enough time to give sufficient detail with complete clarity to be sure that respondents have an accurate understanding of their scores and other feedback. If time is limited, then only as much information as can be understood should be given, as long as it is in itself sufficient to be meaningful. E.g., the total KAI score alone may be fed back and not the sub scores also.

8. All Inventories and scores must be examined and checked before a feedback session. This ensures that any problems arising from the score can be detected in good time in preparing feedback. The knowledge that a problem exists may need a change in the usual feedback arrangements. Such change needs to be allowed for, including any agreement needed with any superior or client.

9. KAI must be administered only to appropriate respondents. That is, those with high (not just adequate) fluency in the language of the KAI. Where possible the appropriate KAI language version will be used. For young people (13 to 17 years) need to follow the relevant guidelines in the manual.

10. Certificated Practitioners† are required to take care with possible vulnerable persons or groups. These include groups whose culture and experience does not extend to accepting this kind of measurement without apprehension. Too many of them may produce invalid responses, possibly at unacceptable cost to themselves in anxiety. Whole groups can also feel threatened in, e.g., periods of turbulence in their organisation (see procedure guidelines in manual).

11. Certificated Practitioners† are required to use the official Feedback Booklet. It should not be replaced by any other without permission. Any other information handout given is a supplement to the approved Feedback Booklet. See guidelines and explanations in manual.

12. Certificated Practitioners† must handle respondents who respond to the KAI defensively with care. Their defences are not to be breached without their express permission and never in public. Counselling should not be offered unless asked for and then only if the Certificated Practitioner is trained to do so.

13. Certificated Practitioners† must keep up to date. For those who certificate or renew certification from 2003 onwards, this will involve attending an Advanced Workshop, for update of certification, every 4 years. This is provided that practice has been maintained by having used a minimum of 100 KAIs over each four-year period. If this practice has not been kept up re-certification will be required in place of the Advanced Workshop.

14. Certificated Practitioners† failing to abide by these conditions of sale may be removed from the Register of Certificated Practitioners†.

These conditions and the supporting guidelines in the manual have been devised for your help and protection as well as for the protection of the respondent

Certificated Practitioner†, throughout the above Conditions of Sale, means a person who is on the Register of Certificated KAI Users and is holding a valid and up-to-date KAI certificate.

Section 2: For prospective delegates to KAI Certification Courses:

1. Deposits and fees paid for courses are non-refundable. If you cancel your booking, are unable to attend the course, or fail to pay fees in full by the final cutoff date (8 weeks prior to commencement of course), your booking is deemed to be void and any fee or deposit paid is forfeit.

2. All payments must be received by the final cutoff date (8 weeks prior to commencement of course). Failure to complete payment by the cutoff date will mean your booking is void and any fee or deposit paid is forfeit.

3. Early-payment discount is only available up to the early-payment cutoff date (12 weeks prior to commencement of course). After this date you will be liable for the full course fee. If you fail to pay the full fee by the final cutoff date (8 weeks prior to commencement of course) your booking is void and your deposit is forfeit.

4. Course places are dependent on fees being paid. We do not reserve any course places until your fee is paid in full. Course places are filled on a first come, first served basis.

5. KAI Distribution Centre Ltd, and its agents and partners, reserve the right to cancel the course at any time prior to the course. In this case your deposit or fee will be refunded. KAI Distribution Centre Ltd, and its agents and partners, will not be liable for any additional or concomitant cost arising from any such cancellation.
